Data collection on this website

Who is responsible for data collection on this website? Data processing on this website is carried out by the website operator. You can find their contact details in the section “Information on the controller” in this privacy policy. How do we collect your data? Your data is collected, on the one hand, by you providing it to us. This may, for example, be data that you enter in a contact form. Other data is collected automatically or with your consent when you visit the website via our IT systems. This is mainly technical data (e.g. internet browser, operating system or time of the page view). Collection of this data takes place automatically as soon as you enter this website. What do we use your data for? Some of the data is collected to ensure the website is provided without errors. Other data may be used to analyse your user behaviour. What rights do you have regarding your data? You have the right at any time to receive information free of charge about the origin, recipient and purpose of your stored personal data. You also have the right to request the rectification or erasure of this data. If you have given consent to data processing, you can revoke this consent at any time with effect for the future. You also have the right, under certain circumstances, to request a restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority. For this and other questions on the subject of data protection, you can contact us at any time.

Analytics tools and third-party tools

When you visit this website, your surfing behaviour may be statistically evaluated. This happens primarily with so-called analytics programmes. Detailed information on these analytics programmes can be found in the following privacy policy.

2. Hosting

External hosting

This website is hosted by an external service provider (hoster). The personal data collected on this website is stored on the hoster’s servers. This may primarily include IP addresses, contact requests, meta and communication data, contract data, contact data, names, website accesses and other data generated via a website. The hoster is used for the purpose of fulfilling the contract with our potential and existing customers (Art. 6 (1) (b) GDPR) and in the interest of secure, fast and efficient provision of our online offering by a professional provider (Art. 6 (1) (f) GDPR). Our hoster will only process your data to the extent necessary to fulfil its performance obligations and will follow our instructions regarding this data. We use the following hoster: RAIDBOXES GmbH Hafenstraße 32 48153 Münster

Order processing

We have concluded an order processing agreement (DPA) with the provider named above. This is a contract required under data protection law that ensures the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

3. General notes and mandatory information

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy. When you use this website, various personal data is collected. Personal data is data that can be used to identify you personally. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done. We point out that data transmission over the internet (e.g. when communicating by email) may have security gaps. Complete protection of data against access by third parties is not possible.

Information on the controller

The controller for data processing on this website is: Guhr Steuerberatungsgesellschaft mbH Auerstraße 14 10249 Berlin Phone: 030 45950487 Mobile: 0176 34397427 Email: guhr@guhr-steuerberatung.de The controller is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data (e.g. names, email addresses, etc.).

Storage duration

Unless a more specific storage period is mentioned within this privacy policy, your personal data will remain with us until the purpose of the data processing ceases to apply. If you assert a legitimate request for erasure or revoke your consent to data processing, your data will be deleted, unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, deletion will take place after these reasons no longer apply.

Note on data transfer to the USA and other third countries

Among other things, we use tools from companies based in the USA or other third countries that are not considered safe from a data protection perspective. When these tools are active, your personal data may be transferred to and processed in these third countries. We point out that no level of data protection comparable to the EU can be guaranteed in these countries. For example, US companies are required to disclose personal data to security authorities without you as the data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent already given at any time. The lawfulness of the data processing carried out until the revocation remains unaffected by the revocation.

Right to object to data collection in particular cases and to direct advertising (Art. 21 GDPR)

IF DATA PROCESSING IS BASED ON ART. 6 (1) (E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA, UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES TO ASSERT, EXERCISE OR DEFEND LEGAL CLAIMS (OBJECTION UNDER ART. 21 (1) GDPR). IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT ADVERTISING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSES OF SUCH ADVERTISING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT IT IS ASSOCIATED WITH SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR DIRECT ADVERTISING PURPOSES (OBJECTION UNDER ART. 21 (2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of breaches of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work or the place of the alleged infringement. The right to lodge a complaint exists without prejudice to any other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in the performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only take place insofar as it is technically feasible.

SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator, this site uses SSL/TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser bar. When SSL/TLS encryption is activated, the data you submit to us cannot be read by third parties.

Information, deletion and rectification

Within the scope of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of data processing and, if applicable, a right to correction or deletion of this data. For this and for further questions on the subject of personal data, you can contact us at any time.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time. The right to restriction of processing exists in the following cases: • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data. • If the processing of your personal data happened/is happening unlawfully, you can request the restriction of data processing instead of erasure. • If we no longer need your personal data, but you need it for the exercise, defence or assertion of legal claims, you have the right to request the restriction of the processing of your personal data instead of erasure. • If you have lodged an objection under Art. 21 (1) GDPR, a balancing of your and our interests must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data. If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.

Objection to advertising emails

The use of contact data published in the context of the imprint obligation to send unsolicited advertising and information material is hereby objected to. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, for example via spam emails.

4. Data collection on this website

Cookies

Our websites use so-called “cookies”. Cookies are small text files and do not cause any damage to your device. They are either stored on your device temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or your web browser automatically deletes them. In some cases, cookies from third-party companies may also be stored on your device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g. cookies for processing payment services). Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies are used to evaluate user behaviour or display advertising. Cookies that are required to carry out the electronic communication process (necessary cookies) or to provide certain functions you have requested (functional cookies, e.g. for the shopping cart function) or to optimise the website (e.g. cookies to measure the web audience) are stored on the basis of Art. 6 (1) (f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing cookies for the technically error-free and optimised provision of its services. Insofar as consent to the storage of cookies has been requested, the storage of the respective cookies takes place exclusively on the basis of this consent (Art. 6 (1) (a) GDPR); consent can be revoked at any time. You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of this website may be limited. If cookies are used by third-party companies or for analytical purposes, we will inform you separately within the framework of this privacy policy and, if necessary, request your consent.

Consent with Borlabs Cookie

Our website uses the consent technology from Borlabs Cookie to obtain your consent for the storage of certain cookies in your browser or for the use of certain technologies and to document this in compliance with data protection regulations. The provider of this technology is Borlabs – Benjamin A. Bornschein, Rübenkamp 32, 22305 Hamburg (hereinafter Borlabs). When you enter our website, a Borlabs cookie is stored in your browser, in which the consents you have given or the revocation of these consents are saved. This data is not passed on to the provider of Borlabs Cookie. The data collected is stored until you ask us to delete it, delete the Borlabs cookie yourself, or the purpose of data storage no longer applies. Mandatory statutory retention periods remain unaffected. Details on Borlabs Cookie data processing can be found at https://de.borlabs.io/kb/welche-daten-speichert-borlabs-cookie/. The Borlabs Cookie consent technology is used to obtain the legally required consents for the use of cookies. The legal basis for this is Art. 6 (1) (c) GDPR.

Contact form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions. We do not pass on this data without your consent. This data is processed on the basis of Art. 6 (1) (b) GDPR, insofar as your request is related to the performance of a contract or is necessary for pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of inquiries addressed to us (Art. 6 (1) (f) GDPR) or on your consent (Art. 6 (1) (a) GDPR) if requested. The data you enter in the contact form remains with us until you ask us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g. after your inquiry has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Inquiry by email, phone or fax

If you contact us by email, phone or fax, your inquiry, including all personal data resulting from it (name, inquiry), will be stored and processed by us for the purpose of handling your request. The data you send to us via contact requests remains with us until you ask us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

ProvenExpert

We have integrated rating seals from ProvenExpert on this website. The provider is Expert Systems AG, Quedlinburger Str. 1, 10589 Berlin, https://www.provenexpert.com. The ProvenExpert seal enables us to display customer reviews about our company submitted to ProvenExpert on our website in a seal. When you visit our website, a connection is established with ProvenExpert, so that ProvenExpert can determine that you have visited our website. Furthermore, ProvenExpert records your language settings in order to display the seal in the chosen national language. The use of ProvenExpert is based on Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in presenting customer reviews as transparently as possible. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6 (1) (a) GDPR; consent can be revoked at any time.

5. Analytics tools and advertising

Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics enables the website operator to analyse the behaviour of website visitors. In doing so, the website operator receives various usage data, such as page views, time spent on the site, operating systems used and origin of the user. This data may be combined by Google in a profile that is assigned to the respective user or their device. In addition, with Google Analytics we can record, among other things, your mouse and scroll movements and clicks. Google Analytics also uses various modelling approaches to supplement the data collected and uses machine learning technologies in data analysis. Google Analytics uses technologies that enable the user to be recognised for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is usually transferred to a Google server in the USA and stored there. The use of this analytics tool is based on Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in analysing user behaviour in order to optimise both its website and its advertising. If corresponding consent has been requested (e.g. consent to the storage of cookies), processing is carried out exclusively on the basis of Art. 6 (1) (a) GDPR; consent can be revoked at any time. Data transfer to the USA is based on the EU Commission’s standard contractual clauses. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

IP anonymisation

On this website, we have activated the IP anonymisation function. As a result, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activities and to provide further services related to website use and internet use to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

Browser plugin

You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de. For more information on how Google Analytics handles user data, please see the Google privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.

Order processing (Google Analytics)

We have concluded an order processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Storage duration (Google Analytics)

Data stored by Google at user and event level, which is linked to cookies, user IDs (e.g. user ID) or advertising IDs (e.g. DoubleClick cookies, Android advertising ID), is anonymised or deleted after 2 months. Details can be found at the following link: https://support.google.com/analytics/answer/7667196?hl=de.

Google Ads

The website operator uses Google Ads. Google Ads is an online advertising programme of Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. Google Ads enables us to place advertisements in the Google search engine or on third-party websites when the user enters certain search terms on Google (keyword targeting). Furthermore, targeted advertisements can be displayed based on the user data available on Google (e.g. location data and interests) (audience targeting). As the website operator, we can evaluate this data quantitatively, for example by analysing which search terms led to the display of our advertisements and how many advertisements led to corresponding clicks. The use of Google Ads is based on Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in marketing its service products as effectively as possible. Data transfer to the USA is based on the EU Commission’s standard contractual clauses. Details can be found here: https://policies.google.com/privacy/frameworks and https://privacy.google.com/businesses/controllerterms/mccs/.

Google Remarketing

This website uses the functions of Google Analytics Remarketing. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. Google Remarketing analyses your user behaviour on our website (e.g. clicks on certain products) in order to assign you to specific advertising target groups and then display matching advertising messages to you when you visit other online offerings (remarketing or retargeting). In addition, the advertising target groups created with Google Remarketing can be linked to Google’s cross-device functions. In this way, interest-based, personalised advertising messages that have been adapted to you based on your previous usage and surfing behaviour on one end device (e.g. mobile phone) can also be displayed on another of your end devices (e.g. tablet or PC). If you have a Google account, you can object to personalised advertising at the following link: https://www.google.com/settings/ads/onweb/. The use of Google Remarketing is based on Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in marketing its products as effectively as possible. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6 (1) (a) GDPR; consent can be revoked at any time. Further information and the data protection provisions can be found in Google’s privacy policy at: https://policies.google.com/technologies/ads?hl=de.

Audience building with customer matching

For audience building, we use, among other things, the customer matching of Google Remarketing. In doing so, we transfer certain customer data (e.g. email addresses) from our customer lists to Google. If the customers in question are Google users and are logged into their Google account, they are shown matching advertising messages within the Google network (e.g. on YouTube, Gmail or in the search engine).

Google Conversion Tracking

This website uses Google Conversion Tracking. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. With the help of Google Conversion Tracking, Google and we can recognise whether the user has carried out certain actions. For example, we can evaluate which buttons on our website were clicked how often and which products were viewed or bought particularly frequently. This information is used to create conversion statistics. We learn the total number of users who clicked on our ads and what actions they carried out. We do not receive any information that allows us to identify the user personally. Google itself uses cookies or comparable recognition technologies for identification. The use of Google Conversion Tracking is based on Art. More information about Google Conversion Tracking can be found in Google’s privacy policy: https://policies.google.com/privacy?hl=de.

Hotjar

This website uses Hotjar. The provider is Hotjar Ltd., Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europe (website: https://www.hotjar.com). Hotjar is a tool for analysing your user behaviour on this website. With Hotjar, we can record, among other things, your mouse and scroll movements and clicks. Hotjar can also determine how long you remained with the mouse pointer at a particular location. From this information, Hotjar creates so-called heatmaps, which can be used to determine which areas of the website visitors prefer to look at. Furthermore, we can determine how long you stayed on a page and when you left it. We can also determine where you stopped entering data in a contact form (so-called conversion funnels). In addition, with Hotjar, direct feedback can be obtained from website visitors. This function serves to improve the website operator’s online offerings. Hotjar uses cookies. Cookies are small text files that are stored on your computer and saved by your browser. They serve to make our offering more user-friendly, effective and secure. With these cookies it can in particular be determined whether this website was visited with a particular device or whether the Hotjar functions have been deactivated for the browser concerned. Hotjar cookies remain on your device until you delete them. You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of this website may be limited. The use of Hotjar and the storage of Hotjar cookies is based on Art. Deactivating Hotjar If you want to deactivate data collection by Hotjar, click on the following link and follow the instructions there: https://www.hotjar.com/opt-out Please note that the deactivation of Hotjar must be carried out separately for each browser or each device. For more information about Hotjar and the data collected, please see the Hotjar privacy policy at the following link: https://www.hotjar.com/privacy

6. Plugins and tools

Google Maps

This site uses the Google Maps map service. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. In order to use the functions of Google Maps, it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer. When Google Maps is activated, Google may use Google Web Fonts for the purpose of uniform display of fonts. When you call up Google Maps, your browser loads the required web fonts into its browser cache in order to display texts and fonts correctly. The use of Google Maps is in the interest of an appealing presentation of our online offerings and easy findability of the places indicated by us on the website. This constitutes a legitimate interest within the meaning of Art. 6 (1) (f) GDPR. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6 (1) (a) GDPR; consent can be revoked at any time. Data transfer to the USA is based on the EU Commission’s standard contractual clauses. Details can be found here: https://privacy.google.com/businesses/gdprcontrollerterms/ and https://privacy.google.com/businesses/gdprcontrollerterms/sccs/. More information on how user data is handled can be found in Google’s privacy policy: https://policies.google.com/privacy?hl=de.

7. eCommerce and payment providers

Processing of data (customer and contract data)

We collect, process and use personal data only to the extent that it is necessary for the establishment, content design or modification of the legal relationship (inventory data). This is done on the basis of Art. 6 (1) (b) GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures. We collect, process and use personal data on the use of this website (usage data) only to the extent that this is necessary to enable the user to use the service or to bill them. The collected customer data will be deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.

Credit checks

In the case of a purchase on account or another payment method where we make advance payments, we may carry out a credit check procedure (scoring). To this end, we transmit your entered data (e.g. name, address, age or bank details) to a credit agency. On the basis of this data, the probability of a payment default is determined. In the case of an excessive risk of payment default, we may refuse the payment method concerned. The credit check is based on the performance of the contract (Art. 6 (1) (b) GDPR) and on the avoidance of payment defaults (legitimate interest under Art. 6 (1) (f) GDPR). If consent has been obtained, the credit check is carried out on the basis of this consent (Art. 6 (1) (a) GDPR); consent can be revoked at any time.

8. Our own services

Handling of applicant data

We offer you the opportunity to apply to us (e.g. by email, post or via online application form). In the following, we inform you about the scope, purpose and use of your personal data collected in the course of the application process. We assure you that the collection, processing and use of your data takes place in accordance with applicable data protection law and all other statutory provisions, and that your data is treated in strict confidence.

Scope and purpose of data collection

If you send us an application, we process your related personal data (e.g. contact and communication data, application documents, notes taken during job interviews etc.) to the extent that this is necessary to decide on the establishment of an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6 (1) (b) GDPR (general contract initiation) and – if you have given consent – Art. 6 (1) (a) GDPR. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons involved in processing your application. If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6 (1) (b) GDPR for the purpose of implementing the employment relationship.

Retention period of the data

If we cannot make you a job offer, you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6 (1) (f) GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. Retention serves in particular for evidentiary purposes in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period has expired (e.g. due to an imminent or pending legal dispute), deletion will only take place when the purpose for further retention no longer applies. A longer retention period may also take place if you have given corresponding consent (Art. 6 (1) (a) GDPR) or if statutory retention obligations preclude deletion.

9. Cookie declaration

The following overview is generated automatically by our consent tool Cookiebot and lists all cookies used on this website, their purpose and storage duration. You can adjust or withdraw your consent at any time via the “Cookie settings” link in the footer.
